Construction Worker Charged with Assaulting Police Officer Complains against Police Abuse during Custody
Eight months since the Yuen Long Terrorist Attack on 21st July, 2019, police had yet quash rumours on their perceived collusion with mobs that day. Netizens initiated the “Never Forget the 721 Attack, 8 Month Anniversary Demonstration” in Yuen Long on 21st March, 2020 and several sit-in actions in various MTR stations in silent protest. These actions had again caused conflicts with the police. Over 60 people were arrested.
Among the arrested, a 42-year-old man was accused of punching a police officer’s back in Fung Kam Street, Yuen Long. At his mention on 23rd March 2020 in Tuen Mun Magistrate Court, he was granted court bail with a curfew. The defence counsel complained in court that the defendant’s upper and lower body were injured by police baton at his arrest and he was admitted to hospital for five and half hours during his custody. The trial of this case would begin on 4th May, 2020 in Tuen Mun Magistrate Court.
Reportedly, the defendant was arrested at around 22:00 on 21st March, 2020. He had not in fact participated in the commemoration actions of the night but was nonetheless arrested during the police arrest campaign.
The defence counsel complained in court that the defendant was taken into police custody for over 36 hours. His arms, chest, torso and lower body shown injuries caused by police batons and needed hospital care for five and half hours during custody.
The defendant was granted bail with the surety of HK$20,000 each from him, his sister and his friend, amounting to a total of HK$60,000. During his bail period, he was not to leave Hong Kong and was to surrender his traveling documents. He was given a curfew from 00:00 to 06:00 each night. He would also need to report to the police once a week.
The male defendant, Tsang Ho Yuen, (42 years old, construction worker), was charged with one charge of assaulting police officer in execution of duty. According to the charge, the defendant assaulted a police officer, Inspector Lee Hin Yeung (18917) at 18 Fung Kam Street, Yuen Long, Hong Kong, outside a 7-11 Shop.

(k)unlawful or unnecessary exercise of authority resulting in loss or injury to any other person or to the Government;
Section 19 Wounding or inflicting grievous bodily harm, Offences against the Person Ordinance (Cap. 212 )
Any person who unlawfully and maliciously wounds or inflicts any grievous bodily harm upon any other person, either with or without any weapon or instrument, shall be guilty of an offence triable upon indictment, and shall be liable to imprisonment for 3 years.
